When one person agrees to a sexual activity with another person, the law says that person has "given consent." According to the Criminal Code of Canada, the age of consent to sexual activity is 14. The Code indicates that children between the ages of 12 - 14 may not be charged criminally if consent for sexual involvement is mutual.

There are situations in which a person cannot legally give consent

1. The person is under 14 and the other is more than 2 years older. 2 One person is between 14 and 17 and the other person is in a position of trust and authority. 3. One person is older than 16 and the other person is in a position of trust and authority.

Consent must be active. Do not assume but ask. If in doubt check it out!
